Stupid Stupid Stupid BOB

I'm compleatly losing it right now. Let me give you background. OK so, January will be 2 years, yes 2 years of remodeling our home. It has been a nightmare. We have lived through our house literally ripped up, our remodeling company going out of business with 90,000 dollars of our money. I'm not one to talk money, unless you're my close friend. It's just not PC, but in this case I really need to convey the gravity of the situation, so I'm telling you the actual dollar amount. Living in complete chaos. Seriously, if you want your relationship to be tested, try living in a torn up home and having to use your retirement money to fix it.

So, for the past few months we brought in a small team to help us fix the house. For the most part it's been good. Oh, unless you count having to fire our alcoholic General Contractor who came to work totally drunk most days. So drunk you could smell the beer on his breath. YUCK! Since then it's been alright until about a week ago. BOB, uh I snarl at the name, has been doing practally nothing. Who the hell thinks they can show up and stand around and get paid $25 an hour?? Who are these people! Finally I'd had enough and on wednesday I let him know it was his last day. I was totally professional, saying we simply could not afford to keep him 5 days a week 8 hrs a day. Firing people sucks! So it's been about 4-5 days since then and today we get a call from BOB, stupid BOB.

He says he hurt his leg on the job a few months ago and he dosn't have insurance to help him. True, he did fall a few months ago and hurt his leg, but he's been working and doing just fine. It's not like he broke his leg or broke his back and has been out of work. Just NOW all the sudden his leg hurts again. I can't imagine he's going to get anything out of us, because we have proof that he's worked everyday not even missing a day, so what can he really do? The problem is that he's going to make this difficult for everyone. Like we havn't been through enough, now we have this ass do deal with.

Why do these construction people have this sence of entitlement. It's not our responsibility to make sure he has a job, it's not our responsibility to make sure he works. This is just a slap in the face.

I just wish someone would sweep in and fix this for us. Does anyone have a wealthy uncle to wants to give us a lot of money? I'm not beneath begging.

What a nightmare Katy! Sounds awful. I hope your house gets finished soon, and no more lame Bob. Let me know if you find a rich uncle.

He probably fell because he was drunk. Does he think you carry a workers comp plan for people working on your house? He need's to get a life. I'm angry for you. What a jerk! Sorry you're going through this.

So Scott said that aparantly when bob initally fell he was saying that if he didn't have this job he may have to file a claim against us and our homeowners ins. Funny how now that he's NOT employed by us, this comes up. Scott is going to call him tomorrow and let Bob know that if he pursues this any further we are going to prosecute him for extortion. Don't mess with the DeJong family

since you're paying this trio a lump amount per hour, you'd think that the main guy (i forgot what his name is), has the insurance on workman's comp. i mean, you guys are a client of theirs...you're not supposed to carry insurance for them. i'd seek legal advice on that one. it might be worth the hourly legal fee.

Katy - this is Sue Aflague...here are the legal channels to complain about your contractor...first of all contact AZ Registrar of Contractors and report your contractor, 602-542-1525, or visit their website WWW.azroc.gov. Also let this contractor know you are persuing it through the Registar of Contractors. By the way, if he isn't a license contractor, then they can persue it through other means, because it is illegal to operate as a contractor without being licensed through the state. He would have to pay some hefty fines if he is an unlicensed contractor - maybe even jail time! If you go online you can complete the complaint online. I would suggest you do this - so that the state could revoke his license, if he has one. This is your easiest route, and it would be the most damaging to him...report the drinking on the job, the fraud, the shabby work he has performed. The threats he has made to you. Also contact your homeowners insurance provider and let them know he has made threats to sue you through your homeowners, because sometimes they can try to go this route, without contacting you first, and your insurance just might pay his cost -- so contact your insurance person and speak to them personally, and explain this situation to them...they only have a certain amount of days to claim injury -- and even if he fell, he did not report this to any one...and as you said he probably fell due to his drinking on the job... questions to ask, when he fell, did he go to the doctor, hospital, etc. any proof other than his of his injuries? Contacting the Registar of Contractors is the easiest and least cost involved. Hope this helps...but, you can see some resolution if you persue it this way, and it doesn't cost you any additional money!!
